Texas lawmakers are set to discuss a proposal aimed at banning all consumable THC products in the upcoming legislative session beginning January 14, 2025. Lieutenant Governor Dan Patrick announced that Senate Bill 3, which would prohibit these products, including those with low levels of THC like delta-8 and delta-9, is among his top priorities.

“We are not going to allow these retailers to circumvent the law and put Texans’ lives in danger,” the Lieutenant Governor said in a statement. “This bill will have broad bipartisan support in the Senate, and I trust the House will also see the danger of these products and pass this bill with overwhelming support so it can become law immediately.”

Although marijuana remains illegal in Texas, a 2019 law promoting agriculture allowed Texans to purchase low-level THC items such as vapes, gummies, and seltzers. Current regulations require consumable hemp products to contain no more than 0.3 percent THC. However, Patrick has expressed concerns that some products on the market exceed this legal limit.

If the proposed bill is approved, the sale of all THC products would be halted, ending the legality of buying these items in Texas. Patrick asserts that the measure is necessary to prevent retailers from exploiting the law to sell products deemed dangerous to the public. He anticipates broad bipartisan support for the bill in both the Senate and the House, emphasizing the urgency for it to become law.
